Section 4 Punishments under the Bharatiya Nyaya Sanhita, 2023
Punishments
- The punishments to which offenders are liable under the provisions of this Sanhita
are—
(a) Death;
(b) Imprisonment for life;
(c) Imprisonment, which is of two descriptions, namely:—
(1) Rigorous, that is, with hard labour;
(2) Simple;
(d) Forfeiture of property;
(e) Fine;
(f) Community Service.

The Bharatiya Nyaya Sanhita, 2023 specifies several types of punishments that offenders may face for committing offenses under its provisions. These punishments are designed to enforce accountability, deter future crimes, and uphold justice.
Types of Punishments:
- Death:
- Description: This is the most severe penalty under the law, where the convicted person is sentenced to death.
- Purpose: It serves as a deterrent against the most serious crimes and is reserved for offenses deemed heinous by the legal system.
- Imprisonment for Life:
- Description: Offenders sentenced to life imprisonment remain incarcerated for the entirety of their natural life.
- Purpose: It ensures removal from society of individuals who pose a significant risk, providing a strong deterrent and reflecting the seriousness of the crime.
- Imprisonment:
- a) Rigorous Imprisonment (with hard labor):
- Description: This type of imprisonment includes hard physical labor as part of the sentence.
- Purpose: It combines confinement with physical exertion, aiming to reform through work and deter through hardship.
- b) Simple Imprisonment:
- Description: Offenders serve their sentence without hard labor.
- Purpose: It involves confinement as a punishment without the additional physical labor, suitable for less serious offenses.
- a) Rigorous Imprisonment (with hard labor):
- Forfeiture of Property:
- Description: In cases where property is acquired through criminal means or used in the commission of a crime, the court may order its confiscation.
- Purpose: This punishment deprives offenders of ill-gotten gains and prevents them from benefiting from their unlawful activities.
- Fine:
- Description: Offenders may be required to pay a specified amount of money as a penalty.
- Purpose: Fines serve both punitive and deterrent purposes, imposing a financial burden on the offender and discouraging future unlawful behavior.
- Community Service:
- Description: Offenders are mandated to perform unpaid work for the benefit of the community.
- Purpose: It promotes rehabilitation by encouraging offenders to contribute positively to society, making amends for their actions.
Purpose of Punishments:
- Deterrence: Punishments such as death penalty, life imprisonment, and rigorous imprisonment deter individuals from committing serious crimes.
- Rehabilitation: Imprisonment (both rigorous and simple) and community service aim to rehabilitate offenders and reintegrate them into society.
- Restitution: Forfeiture of property ensures that offenders do not benefit from criminal activities and compensate victims or society.
- Social Responsibility: Fines and community service emphasize the offender’s responsibility to society and the need to make amends for wrongdoing.
